Kim Zolciak's daughter Ariana Biermann said she wasn't drinking and only used marijuana before DUI

Kim Zolciak’s daughter Ariana Biermann reportedly denied drinking and claimed she had only used marijuana much earlier when she was booked for driving under the influence of alcohol in Forsyth County, Georgia, early Saturday morning.

The police reported indicates that despite the 20-year-old Don’t Be Tardy star’s denials, officers told her that they could smell booze on her breath and possiblyy even on her clothes, according to TMZ.

According to the police, Biermann admitted that she had ‘smoked a THC vape pen the night before but did not drink.’

However, it’s unclear if ‘the night before’ refers to Friday night, just a few hours before she was booked, or if she was claiming that she had last smoked a marijuana vape on Thursday night.

According to Drugs and Mewhich is run by the Mental Health Education Foundation, the intoxicating effects of marijuana vape tend to last around around 1 to 3 hours after use, though they can linger for up to 8 hours.

Ariana was booked into the system after 1 a.m. on Saturday morning.

Despite Biermann’s contention that she had not been drinking, officers allegedly saw a ‘noticeable sway’ from her when she did a field sobriety test.

Timeline: Ariana was booked into the system after 1 a.m. on Saturday morning, so it's unclear if she meant that she vaped just hours earlier on Friday night, or on Thursday night

It’s also not clear if she was ever given a breathalyzer or a blood test to determine more conclusively if she had been drinking.

Biermann faces three separate charges including misdemeanor DUI driving under the influence of alcohol, misdemeanor improper/erratic lane change and underage alcohol possession/purchase of alcohol.

She has since been released on bond.

Her on-and-off boyfriend, Hudson McLeroy, who is also 20, was arrested at the same time on alcohol-related charges while Ariana was in the car with him, according to TMZ.

McLeroy was booked for DUI, together with a charge of furnishing/purchasing alcohol under 21 and violating his driving permit.

However, it appears that Ariana’s charges may be the more serious of the pair as she was behind the wheel at the time of her arrest.

‘Ariana was involved in a minor fender bender. When police arrived on scene, the investigating officer immediately initiated an investigation for DUI,’ her lawyer told TMZ.

‘Despite Ariana’s constant invocation that she was upset and anxious from the minor accident, the officer incorrectly concluded she was impaired by alcohol. That was not the case. She wholly denies these allegations and intends to fight these charges because she is not guilty of them.’
