Kevin Hart wants his sex tape lawsuit thrown out because he wasn’t served his papers properly, according to reports.

TMZ says the comedian has filed claims that the papers in question were thrown out of a car window by a plaintiff and left on his driveway.

According to documents obtained by the publication, Hart complained that a driver ‘simply threw a set of papers out of a car window in view of a security guard.’

Hart is being sued for $60 million (£45.9 million) by alleged sex tape partner Montia Sabbag.

She has accused Hart of secretly filming their 2017 encounter; she claims he planned the recording along with his close friend (at the time) Jonathan Todd Jackson. She believes the recorded tryst was orchestrated to create publicity for a comedy tour

Hart married his wife Eniko Parish in 2016. They share a son named Kenzo, who is two.

Kevin is also a dad to Hendrix, 12, and Heaven, 14, from a previous relationship.

Shortly before news of his alleged affair with Sabbag broke in 2017, Hart took to Instagram, hinting he was being extorted and apologising to his family.

Addressing the news over the lawsuit on Instagram back in September 2017, Kevin wrote: ‘Sending so many apologies to my wife & kids. I gotta do better and I will.’

He added: ‘I’m at a place in my life where I feel like I have a target on my back, and because of that, I should make smart decisions. And recently, I didn’t.’

‘I’m not perfect and have never claimed to be …I love you all.’

After news of the video broke, Sabbag said at a press conference: ‘I am not an extortionist. I had nothing to do with these recordings.’

Hart’s friend Jackson was later charged with extortion, but the charges were dropped last year.
