The Real Housewives of Orange County star received a temporary restraining order after she accused Matt of ‘choking and hitting her’ during a fight at their home on June 22.

Matt is ‘pleading the 5th amendment’ in response to the allegations, and hopes a previously arranged divorce settlement will be enforced to allow him the chance for some time with his children despite orders requiring him to stay at least 100 yards away from his family until a hearing next month.

The couple’s split was documented on the reality show last year and they ‘reached a custody deal’ before a short reconciliation.

The agreement — which was reportedly finalized in December — included joint legal custody with Matt receiving visitation.

He’s asking that the arrangement remain in effect with a clause for monitored visits despite the arrest and possible criminal charges.

Gina accused her estranged husband of choking, hitting and threatening to kill her during a violent altercation at home.

In her restraining order, she claimed Matt was ‘screaming in my face and saying he was going to kill me.

‘He started to hit me on the side of the head with his open hand. When I tried to get up off of the couch, he threw me back down and began choking me. Then he started to hit me all over my body.’

The mother-of-three claimed she fled the house, screaming to her neighbors and ringing their door bell.

Matt ‘grabbed me and dragged me on the cement back into the house. He threw me back on the couch started hitting me again telling me he was going to kill me. His eyes were black and nothing I could say would bring him back to reality.’

Gina, who shares three children with Matt, filed for divorce last year, but recently hinted they were on the path to reconciliation with a sweet birthday tribute to her husband a few weeks before the arrest.

‘Happy birthday to the man who has held my hand for the last 14 years despite the ups and downs,’ she wrote.  ‘Thanks for being the best father to our kids, and the best friend a girl could ask for. Wouldn’t want to take on this crazy life with anyone else. Like you said, “I’m your person and you’re mine.” ❤️ Happy Birthday Matthew.’

Viewers watched the end of her marriage play out as she moved into the back house of their home to have her own space but stay close to the kids.

The reality star had a brush with the law earlier this year after she was arrested for DUI on January 31.
