Cuba Gooding Jr has returned to court to face charges for a new crime amid his sexual assault case.
Last week, the Boyz N The Hood star appeared in court for the first time, with his trial being delayed to start on Thursday.
However, TMZ has reported that when Gooding Jr appeared in court on Thursday, the district attorney told the judge that there was an ‘additional incident’ forming a new charge.
Little is known about the nature of the second charge, meaning that it is unclear whether the victim is the same woman who initially accused the actor.
Gooding Jr, 51, turned himself in to the police in June after being accused of grabbing a 29-year-old woman’s breast in a Manhattan bar, something he denies doing.
He is charged with forcibly touching and sex abuse in the third degree.
Both charges are misdemeanours.
If convicted, Gooding Jr could face up to one year in jail, but his defense team has provided a CCTV video from the bar which they claim will prove that Cuba is innocent of the allegations.
The video, which was published by TMZ, shows the star sat on a couch with the woman, with his girlfriend sat in between them.
Gooding Jr’s defence attorney claims the woman made the accusations after they felt rejected by him and his girlfriend as the couple asked her to leave them alone when they spotted that she was following them around.
Addressing reporters after the first hearing, Gooding Jr.’s lawyer Mark Heller said: ‘Cuba is extremely confident that this case will be dismissed.’
He continued: ‘Cuba takes the position, and we do as well, that he is someone that should never have been prosecuted.’
