Amber Heard’s motion to dismiss Johnny Depp’s defamation suit denied after domestic abuse allegations

Amber Heard’s motion to dismiss her ex-husband Johnny Depp’s defamation suit against her has been dismissed.

Depp launched a $50million (£40million) defamation lawsuit against Amber, following an op-ed she wrote for the Washington Post in December – alleging she was a victim of domestic abuse, without naming her abuser.

Fairfact County Chief Judge Bruce White wrote in a statement: ‘Defendant’s Demurrer is sustained as to the fourth statement listed above, but it is overruled as to the other three statements,’ according to Deadline.

He added: ‘Further, Defendant’s Plea in Bar regarding the statute of limitations is denied. Counsel shall prepare an Order reflecting the Court’s ruling and forward that Order to the Court for entry.’

Heard’s attorney, Roberta Kaplan, told Metro.co.uk in a statement: ‘Today’s decision leaves it to a jury to decide the meaning of Ms. Heard’s op-ed and the truth of what she said. 

‘As we have said all along, the courts have strong mechanisms in place for determining the truth.  Here, we remain confident that Ms. Heard will prevail at trial when the jury is presented with evidence on the question that the Court identified – namely, whether “Ms. Heard was abused by Mr. Depp.”‘

Pirates of the Caribbean star Depp has claimed that Heard’s ‘fabricated domestic violence allegations are categorically and demonstrably false’ and his lawyers argued it was an attempt to ‘smear’ his name.

Johnny, 56, and Amber, 33, who were married from 2015 to 2017, have thrown domestic abuse allegations at each other in the past.

Amber previously alleged that her ex-husband ‘shoved her into a ping-pong table’, grabbed her and then ‘tore her nightgown’ before he ‘slammed her against the countertop and strangled her’.

She claimed he ‘severely injured his finger, cutting off the top’, while he smashed a phone against a wall during the scenes, according to barrister Adam Wolanski.

However, the actor instead claimed Amber threw a glass bottle at him, which smashed and fractured his finger, before she ‘put a cigarette out on his right cheek’.
